In this Privacy Policy, “Amodo” means Amodo Pty Ltd (ACN 626 999 004) and its affiliates.

Amodo is committed to respecting your privacy. This Privacy Policy sets out how Amodo collects, processes, stores and discloses your personal information relating to your access to and use of Amodo’s website and any application provided by Amodo (“Platform”).

You do not have to provide personal information to Amodo, however, if you do not, it may affect your use of, and access to the Platform. By agreeing to this Privacy Policy and providing personal information to Amodo, you consent to our collection, use and disclosure of your personal data in accordance with this Privacy Policy.

1. Collection of personal information

Amodo may collect the following types of personal information:

  • name, email address, location, or any other information entered when you create an account;
  • payment information when you make a purchase;
  • any preferences specified in your account or through your use of the Platform;
  • services provided to you or that you have enquired about;
  • information you provide to Amodo through customer surveys;
  • your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;
  • information about your access and use of the Platform, including through the use of cookies, your communications with the Platform, the type of browser you are using, the type of operating system you are using and the domain name of your internet service provider;
  • any additional information relating to you that you provide to Amodo directly through the Platform or indirectly through your use of the Platform or online presence or through other websites or accounts from which you permit Amodo to collect information; and
  • any other personal data that may be required in order to facilitate your dealings with Amodo.

For instructors, Amodo may also collect any further information that you submit in creating your instructor account, profile and in any content, including social media account details, profile images, videos, payout details, specialisations, qualifications, and accreditations.

Amodo may collect this personal information either directly from you, or from third parties, when you:

  • register, use, or access the Platform;
  • communicate with Amodo through correspondence, chats, email, or when you share information with Amodo from other social applications, services or websites; and/or
  • interact with the Platform, services, content and advertising.

If Amodo receives personal information about you from a third party, Amodo will protect it in accordance with this Privacy Policy.

2. Use of personal information

Amodo may use your personal data for the following purposes:

  • to enable you to access and use the Platform and to perform the services for which you have signed up;
  • to operate and enhance our Platform;
  • to customise your user experience;
  • for internal record keeping and administrative purposes including accounting payment information, billing, and audits;
  • to verify your identity;
  • to perform verification/screening of credit/debit cards or other payment methods and to detect or prevent any fraudulent activities;
  • to process financial transactions, including payments and payouts;
  • for analytics, market research and business development, including to operate, protect, improve and optimise the Platform, business, associated applications and associated social media platforms;
  • to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by Amodo;
  • to send you mandatory communications, including service, support and administrative messages, reminders, technical notices, updates, security alerts;
  • for advertising and marketing purposes, including sending you promotional information about our products and services and information about third parties that Amodo considers may be of interest to you should you choose to opt in;
  • to send you any information requested by you; and
  • to comply with our legal obligations, resolve any disputes that Amodo may have with any members or instructors, and enforce our agreements with third parties.

Additionally, for instructors, Amodo may use your personal data for the following purposes:

  • to verify any information in your instructor account, profile, and content; and
  • to publish on the Platform and to use for promotional, advertising and marketing purposes, any information that may be contained in your custom page(s) and any uploaded content that you have made publicly available.

3. Disclosure of personal information

Amodo may disclose your personal information for the purposes described in this Privacy Policy to:

  • any party with whom you have engaged with via the Platform;
  • any member(s) with whom you share a live stream with via the Platform (including your name, video feed (when shared), and audio feed (when shared));
  • third party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, web-hosting and server providers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators;
  • our employees, contractors and/or related entities;
  • our existing or potential agents or business partners;
  • sponsors or promoters of any competition Amodo conducts;
  • anyone to whom our business or assets (or any part of them) are, or may (in good faith) be, transferred;
  • third parties, including agents or sub-contractors, who assist Amodo in providing information, products, services or direct marketing to you;
  • third parties to process payments and/or payouts;
  • third parties to collect and process data;
  • specified third parties authorised by you to receive information from us;
  • credit reporting agencies, courts, tribunals and regulatory authorities, in the event of failure to pay for services that Amodo has provided; and
  • courts, tribunals, regulatory authorities and law enforcement officers and agencies, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights.

Amodo may transfer, store, and process your personal information on systems located outside of your country, state, province, or other jurisdiction where privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to the potential transfer, storage, and processing of your personal information outside of your jurisdiction. Amodo makes all reasonable commercial efforts to keep such information secure as detailed in this Privacy Policy.

4. Storage and security of personal information

Amodo and instructors on the Platform with whom you have a relationship with may hold your personal information in either electronic or hard copy form. Amodo takes reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. Amodo uses a variety of industry-standard security measures and procedures to help protect your personal information including firewalls, secure servers, and encryption.

We require instructors to adhere to either this Privacy Policy or to a privacy policy no less restrictive than this Privacy Policy when dealing with any personal information provided by Amodo to an instructor. Amodo is not responsible for any breach of these privacy practices by instructors on the Platform but may suspend or remove the account of any instructor found to be in breach.

Where personal information is stored and/or disclosed outside of Australia, Amodo will take reasonable steps to ensure that any overseas recipient will deal with such personal information in a way that is consistent with the Australian Privacy Principles.

Amodo requires you to enter a password to access your account information. Amodo will never ask you for your password and you will never reveal it to anyone, including anyone purporting to be Amodo. You should always sign out of your account once you have completed a session and you should change your password regularly.

No method of transmission over the internet or method of electronic storage is completely secure and the transmission and exchange of personal information is carried out at your own risk. Whilst Amodo takes measures to safeguard against unauthorised disclosures of information, Amodo cannot assure you that the personal information collected will not be disclosed in a manner that is inconsistent with this Privacy Policy.

5. Third-party payments

Third party payment processors are used to process payments made to Amodo or any instructor. In connection with the processing of payments, Amodo and any instructor do not retain any personally identifiable information or financial information such as credit card numbers (other than the last four digits and expiry). All relevant personal and financial information is provided directly to our third party processor, Stripe, whose use of your personal information is governed by their privacy policies, available at www.stripe.com.

6. Cookies and web beacons

Amodo may use cookies or other similar tracking technologies on the Platform from time to time. Cookies are small text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell Amodo your email address or other personally identifiable information. They do allow third parties, such as Google and Facebook, to display our advertisements on your social media and online media feeds as part of any potential retargeting campaign. If and when you choose to provide the Platform with personal information, this information may be linked to the data stored in the cookie.

Amodo may use web beacons on the Platform from time to time. Web beacons are small pieces of code placed on a web page to monitor the visitor’s behaviour and collect data about the visitor’s viewing of a web page. For example, web beacons can be used to count the visitors who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

7. Third-party websites and platforms

The Platform may contain links to third-party websites and platforms that are not operated or controlled by Amodo and that are provided for your convenience. Unless expressly stated otherwise, Amodo is not responsible for the privacy practices of, or any content on, those linked websites or platforms, and has no control over or rights in those linked websites or platforms. The privacy policies that apply to those other websites or platforms may differ substantially from this Privacy Policy, so Amodo encourages you to read them before using those websites or platforms.

8. Correcting your personal information

If you believe that any information Amodo holds about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may update that personal information in your account. If you are unable to update that information yourself, you may request a correction of that personal information and Amodo will take reasonable steps in a reasonable timeframe to correct the information.

9. Communications

If you have agreed to Amodo or any instructor using your personal information for receiving marketing and communications material, you may change your mind at any time by unchecking the communications box in ‘My account’ or by clicking the unsubscribe link on any marketing emails. You understand and agree that any email correspondence that does not include an unsubscribe link is mandatory and administrative in nature and cannot be unsubscribed from.

10. Deletion

You may request deletion of your personal information at any time. Please note that Amodo may be required to keep certain information and not delete or destroy it (or to keep this information for a certain time, in which case Amodo will comply with your deletion request only after Amodo has fulfilled such requirements). When Amodo deletes or destroys any information, it will be deleted from the database and/or destroyed but may remain in our archives.

11. Contact

For any questions, requests, or notices, please contact Amodo using our contact form. Amodo may need to request specific information from you as a security measure to help Amodo confirm your identity. If your request is unfounded, unreasonable, excessive, damaging, unlawful, or prejudicial, Amodo may charge a reasonable fee or refuse to comply with the request in such circumstances.

If you believe that Amodo has breached the Australian Privacy Principles and wish to make a complaint, please contact Amodo and provide full information with regards to the alleged breach. Amodo will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps Amodo will take to deal with your complaint.

12. Changes to the Privacy Policy

Amodo may vary this Privacy Policy from time to time by publishing the amended Privacy Policy on the Platform. Amodo recommends you check the Platform regularly to ensure you are aware of our current Privacy Policy.
